NOTICE:  PERSONS UNDER THE AGE OF 17 WHO WANT TO TAKE A DRIVING SAFETY COURSE MUST MAKE THE REQUEST IN OPEN COURT IN THE PRESENCE OF A PARENT OR GUARDIAN.

   When a citation has been given for a traffic offense, Defensive Driving may be an option. On a plea of “guilty” or “no contest”, a defendant may request Defensive Driving for the dismissal of his/her misdemeanor charge. 

   Upon approval by the Judge, the defendant would be required to complete a course  approved by the Texas Education Agency within 90 days.  In addition, the following requirements must be met:

·          A valid Texas Driver’s License or permit must be presented, and

·          Proof of Financial Responsibility (insurance), and

·          Provide evidence that the driving record as maintained by the Department of Public Safety does not show a completed driving safety course within the past 12 months, and

·          File an affidavit with the Court that the defendant is not taking a course under Article 45.051 of the C.C.P. and has not completed a course that is not shown on the person’s driving record within the 12 months preceding the date of the offense, AND

·          PAY COURT COSTS.

     The Judge will not approve the defendant to take Defensive Driving if all the above requirements are not met.

     If the driving safety course is completed WITHIN 90 days, the misdemeanor charge will be dismissed and the Court will report to the Department of Public Safety the completion of the course for inclusion on the defendant’s record.

     If the defendant fails to complete the course and does not show evidence of completion within 120, the court will require the defendant to appear in Court for a Show Cause Hearing.   If he/she does not appear for the hearing, the court will impose the fine and may issue a warrant for his/her arrest.
